[브레이크뉴스=배종태 기자] 나경원 의원은 최근 국회를 통과한 개정 형사소송법에 대해 "대통령은 형사소송법에 대해서는 법률안 거부권을 행사하라"며 즉각적인 거부권 행사를 촉구했다.
나 의원은 2일 페이스북을 통해 "엊그제 통과된 개정형소법이 서민에게 피눈물 나게 하는 법, 약자에게는 마지막 안전장치를 제거하는 법"이라며, "당연히 대통령은 국민을 사랑한다면, 정의롭고 공정한 세상을 꿈꾼다면 거부권 행사를 하는 것이 헌법상 책무"라고 지적했다. 이어 이번 개정안에 "황당한 것은 꼼수 공소기각규정이 포함되어 있다는 것"이라고 비판했다.
꼼수 공소기각규정과 사법파괴 논란 나 의원은 "이재명 대통령 집권 후 사법파괴의 역사를 보면 가히 기가 막힌다"며, "입이 다물어지지 않는 기괴한 짓들이 계속 벌어진다"고 직격했다.
이어 이러한 행태의 이유에 대해 "오로지 대통령이 퇴임 후 중단된 재판이 재개 되었을 때의 처벌이 두려워 그 처벌을 피하고자 벌이는 일들 아닌가?"라며, "대법관을 증원해 본인 임기내 22명이나 임명하여 본인 사건이 본인에게 유리하게 판단되게 하려는 것은 물론이고 4심제를 만들어 본인이 장악했다고 판단하는 헌재의 판단을 최종심으로 하여 또다른 안전장치를 마련했다"고 비판했다. 또한 "법왜곡죄로 판.검사를 처벌하겠다며 협박하는 것은 귀여운 투정일 수 있다"고 꼬집었다.
아울러 "그리곤 끊임없이 검찰을 압박해 기소자체가 잘못되었다고 공소취소를 압박 중"이라며, "그게 여의치 않을 때를 대비하여 특검이 공소취소를 할 수 있는 길도 열어 두었다"고 지적했다.
나 의원은 이어 "공소취소가 1심 중에만 가능할 뿐 아니라 불가능할 수도 있다고 판단, 이번에는 판사들을 압박한다"며, "형사소송법을 개정하여 공소기각사유에 불명확한 개념인 '현저한', '중대한'이라는 사유를 포함하여 추가시키면서 위헌적 공소기각규정을 신설했다"고 비판했다.
나 의원은 "대장동은 터무니 없는 항소포기로 공범들에게 수천억원의 이익을 그대로 안겨주면서 본인이 빠져나갈 구멍을 만들고, 대북송금 사건은 연어회술파티 등으로 필사적으로 조작기소로 내모는 작업을 벌였다"고 주장했다.
이어 "박상용검사가 타겟이었다"면서도 "그러나 이화영 전부지사가 국회에서 연어회술파티가 있었다고 진술한 부분에 대해 위증으로 징역 4개월이 선고되면서 이부분은 무위로 끝나는 수순"이라고 덧붙였다.
또한 "참, 이 모든 어이없는 짓거리에 국회, 법원, 검찰, 언론 등 국가의 모든 기관이 동원된다"며, "국민갈등은 또 어떤가? 한마디로 헌정질서가 베베 꼬이면서 파괴되는 것은 물론 국론의 분열과 불필요한 낭비로 대한민국이 이제 가장 정치적으로 후진 비민주국가화 되고 있다"고 우려했다.
"대통령 재판 재개만이 유일한 해법" 나 의원은 "이것을 풀 해법은 딱 하나이다"라며, "바로 엄정한 헌정질서회복, 사법질서의 집행이다"라고 강조했다. 그 해법으로 "바로 '대통령재판재개'"라고 주장했다.
이어 "작년 대통령선거 이후 5개 재판부는 모두 재판을 중단했다"며, "일부 재판부는 명시적으로 헌법 제84조 대통령의 불소추특권을 그 이유로 언급했고, 다른 재판부는 동 조문을 언급하지는 않았지만 같은 취지를 그 이유로 삼았다"고 설명했다.
그러나 "그런데 지난 7월 9일 대법원에서 확정된 윤 전대통령의 판결에 따르면, 헌법상 불소추특권은 수사에는 적용되지 않는다는 판시를 하였고, 특히 대통령의 직무수행이나 국가원수로서의 권위 확보에 지장을 초래하지 않는 범위 내의 수사는 가능하다고 설시하였다"고 밝혔다.
따라서 "재판에게도 같은 해석이 적용된다면 재판 역시 불소추특권의 대상에 해당되지 않는다 할 것"이라며, "이제 각급 재판부가 재판을 재개하는 것은 용기나 소신이 아니다. 법리에 따른 것이고, 대법원 판결을 존중하는 것"이라고 강조했다.

Rep. Na Kyung-won has called on the president to immediately veto the recently passed amendment to the Criminal Procedure Act, arguing that the legislation would undermine justice and weaken legal protections for ordinary citizens.
In a Facebook post on August 2, Na described the revised law as one that would "bring suffering to ordinary people" and "remove the last safeguard for the socially vulnerable." She argued that if the president truly values justice and fairness, exercising the constitutional veto power is both appropriate and necessary.
Controversy Surrounding the "Loophole" Case Dismissal Provision and Judicial Undermining Na took particular issue with a newly added provision allowing courts to dismiss prosecutions under certain circumstances, referring to it as a "backdoor dismissal clause."
She accused President Lee Jae-myung of systematically weakening the judicial system since taking office, claiming that recent legal and institutional changes were aimed at avoiding criminal liability after leaving office.
According to Na, proposals to expand the number of Supreme Court justices, establish a four-tier court system, and introduce legislation that could punish judges and prosecutors for alleged distortions of the law are all part of an effort to influence future rulings in the president's favor.
She also alleged that the administration has pressured prosecutors to withdraw indictments and has sought to create additional legal mechanisms that would allow special prosecutors to dismiss cases if necessary.
Na further argued that the revised Criminal Procedure Act creates an unconstitutional basis for dismissing prosecutions by introducing vague standards such as "manifest" and "serious," which she said could be subject to arbitrary interpretation.
She also claimed that the government's handling of several high-profile criminal cases—including the Daejang-dong development scandal and the alleged illegal remittance to North Korea case—was intended to benefit the president politically.
"Resuming the President's Trials Is the Only Solution" Na argued that restoring constitutional order and respect for the rule of law requires the immediate resumption of the criminal trials involving President Lee.
She noted that five separate courts suspended proceedings following the presidential election, with some explicitly citing Article 84 of the Constitution, which grants a sitting president immunity from criminal prosecution, while others relied on the same principle without directly referencing the provision.
However, Na pointed to a Supreme Court ruling finalized on July 9 concerning former President Yoon, saying the Court held that presidential immunity from prosecution does not extend to criminal investigations and that investigations may proceed as long as they do not interfere with the president's official duties or constitutional role.
Based on that reasoning, Na argued that the same interpretation should apply to criminal trials.
