[Here is the English version of the article] Busan Education Superintendent Kim Seok-jun Acquitted on Appeal in Formerly Dismissed Teachers’ Special Hiring Case
Busan Education Superintendent Kim Seok-jun was acquitted on appeal on Aug. 20 in a case involving the special hiring of four formerly dismissed teachers.
The Busan District Court’s Criminal Division 4-3, presided over by Judge Kim Do-gyun, overturned the lower court’s ruling, which had sentenced Kim to eight months in prison, suspended for two years, and instead found him not guilty of charges including abuse of authority.
The appellate court found it difficult to conclude that Kim’s involvement in the 2018 special hiring process constituted an abuse of authority. The court determined that the purpose and procedures of the special hiring had legitimacy and that the process could be viewed as part of an effort to provide relief to the dismissed teachers based on legal advice.
The court also ruled that the special hiring itself could not be considered unlawful. It found that Kim’s direction to education officials to proceed with the special hiring process, in the exercise of his authority as superintendent, did not necessarily constitute an abuse of authority subject to criminal punishment.
The appellate court also raised concerns about the prosecution’s presentation of the case. According to reports, the court pointed out that some aspects of the prosecution’s indictment did not accurately reflect the actual circumstances surrounding the special hiring process.
The lower court had previously found Kim guilty, ruling that he had used his position as superintendent to make personnel officials perform duties they were not legally obligated to perform. It sentenced him to eight months in prison, suspended for two years.
The appellate court, however, reached a different conclusion after considering the purpose of the special hiring, the circumstances in which it was initiated, the procedures followed and the relevant legal advice.
Following the acquittal, Kim issued a statement saying the ruling had allowed him to protect the honor of both himself and the Busan education community. “I sincerely thank the court for making a wise decision based on the substantive truth,” Kim said.
He also thanked members of the Busan education community and citizens for supporting him throughout the case, and expressed hope that the ruling would bring an end to unnecessary controversy surrounding the special hiring case. “From now on, I will do my utmost for the advancement of education in Busan,” Kim said.
