[브레이크뉴스=배종태 기자] 부산시 특별사법경찰과가 온라인 쇼핑몰과 사회관계망서비스(SNS)에서 의약품과 의료기기, 화장품, 위생용품을 불법으로 광고하거나 판매하는 행위를 집중 단속한다.

단속은 10월 1일부터 12월 31일까지 진행된다. 특사경은 질병명과 치료·개선 등 주요 검색어를 활용해 불법 행위가 의심되는 업체를 선별한 뒤 온라인 광고와 판매 내용을 확인하고 필요한 경우 현장 수사에 나설 예정이다.

온라인 불법 광고·판매 행위 집중 수사

이번 수사는 온라인을 통한 의약품과 의료기기 등의 구매가 늘면서 제품의 효능과 효과를 허위 또는 과장해 광고하거나, 허가·인증·신고를 받지 않은 제품을 판매하는 사례를 차단하기 위해 마련됐다.

주요 단속 대상은 의약품의 효능·효과에 대한 거짓·과장 광고, 무허가·무신고 의료기기 판매와 허위·과대광고, 화장품을 의약품으로 오인하게 하는 광고, 위생용품의 허위·과대광고와 표시사항 위반 등이다.

시는 온라인 광고와 판매 과정에서 위법 행위가 확인되면 관련 법령에 따라 형사 입건하는 등 엄정하게 조치할 방침이다.

품목별 허위·과대광고 처벌

의약품의 효능·효과를 거짓 또는 과장해 광고하면 1년 이하의 징역이나 1천만원 이하의 벌금에 처해질 수 있다. 의료기기의 성능이나 효과 등을 거짓·과장해 광고한 경우에는 3년 이하의 징역 또는 3천만원 이하의 벌금이 부과될 수 있다.

화장품을 의약품으로 오인하게 하거나 거짓·과장 광고를 한 경우에는 1년 이하의 징역 또는 1천만원 이하의 벌금에 처해질 수 있다. 위생용품의 성분·용도·효과 등을 허위 또는 과장해 광고한 경우에도 관련 법령에 따라 같은 수준의 처벌을 받을 수 있다.

부산시 특사경은 약사법, 의료기기법, 화장품법, 위생용품관리법 위반 행위에 대한 시민 제보도 받고 있다. 제보는 부산시 특별사법경찰과 공중위생수사팀(051-888-3104~3106)으로 하면 된다.

Busan’s special judicial police will launch a three-month crackdown on illegal advertising and sales of medicines, medical devices, cosmetics and sanitary products on online shopping platforms and social media.

The investigation will run from Oct. 1 through Dec. 31. Investigators will use search terms related to diseases, treatment and health improvements to identify businesses suspected of illegal activity, then examine their online advertisements and sales practices and conduct on-site investigations when necessary.

Focus on Illegal Online Advertising and Sales

The crackdown comes as online purchases of medicines, medical devices and other health-related products continue to grow, raising concerns over false or exaggerated claims about product safety and effectiveness and the sale of products that have not received the required authorization, certification or registration.

Investigators will target false or exaggerated claims about the effects of medicines, the sale and advertising of unauthorized or unregistered medical devices, advertisements that could lead consumers to mistake cosmetics for medicines, and false or exaggerated advertising or labeling violations involving sanitary products.

Businesses found violating the law may face criminal charges and other penalties under the relevant regulations.

Penalties for False or Exaggerated Claims

Those who make false or exaggerated claims about the effects of medicines can face up to one year in prison or a fine of up to 10 million won ($6,700). False or exaggerated advertising about the performance or effects of medical devices can carry a penalty of up to three years in prison or a fine of up to 30 million won.

Businesses that advertise cosmetics in a way that could cause consumers to mistake them for medicines, or that make false or exaggerated claims, can face up to one year in prison or a fine of up to 10 million won. Similar penalties apply to false or exaggerated claims about the ingredients, uses or effects of sanitary products.

City Seeks Public Reports

Busan’s special judicial police are also accepting reports from residents about violations of the Pharmaceutical Affairs Act, Medical Devices Act, Cosmetics Act and Sanitary Products Management Act.

Reports can be made to the city’s public health investigation team at 051-888-3104 to 3106.

Busan Mayor Jeon Jae-soo said consumers can have difficulty determining the safety and effectiveness of products based solely on online advertising as purchases of medicines and related products increase.

“We will actively crack down on illegal online advertising and sales to ensure that residents can purchase medicines and other products with confidence and to create a safer and more transparent distribution and sales environment,” he said.
