[브레이크뉴스=배종태 기자] 국민의힘 김미애 국회의원(해운대을)이 외국인범죄 통계를 국적별·체류자격별로 체계적으로 작성·공개하도록 하는 「출입국관리법 일부개정법률안」을 5일 대표발의했다.

이번 개정안은 출입국·외국인정책을 보다 합리적으로 수립·평가하기 위해 통계의 작성 범위와 기준을 법률에 명확히 규정하는 데 초점을 맞췄다. 현행법상 법무부는 출입국 현황과 체류외국인 통계를 정기적으로 공표하고 있으나, 외국인범죄 통계는 국적별·체류자격별로 정리·관리할 명확한 법적 근거가 없어 범죄 특성 분석과 정책 설계에 한계가 있다는 지적이 제기돼 왔다.

개정안에 따르면 법무부장관은 출입국 현황과 국적별·체류자격별 외국인 체류 현황은 물론, 외국인범죄 사건에 관한 통계를 포함한 자료를 매년 1회 이상 작성·공개해야 한다. 통계의 정확성과 신뢰성 제고를 위해 관계기관의 장에게 자료 제출을 요청할 수 있는 법적 근거도 마련했다. 통계의 작성·관리 및 공개에 관한 구체적인 사항은 대통령령으로 정하도록 했다.

김 의원은 “외국인정책은 감정이나 정치논리가 아니라 정확한 통계와 객관적 데이터에 기반해 설계돼야 한다”며 “이번 개정안은 외국인범죄를 과장하거나 특정 집단을 낙인찍기 위한 것이 아니라, 정책적으로 중요한 변수인 국적과 체류자격을 기준으로 현황을 정확히 파악해 실효성 있는 정책을 마련하기 위한 최소한의 제도 정비”라고 밝혔다.

이어 “체계적인 통계 없이 정책을 논의할 경우 국민 불안을 키우거나 정책 실패를 반복할 위험이 있다”며 “법 개정을 통해 출입국·외국인정책을 보다 투명하고 합리적으로 운영할 제도적 기반을 마련하겠다”고 강조했다.

해당 개정안은 국회 법제실의 공식 검토를 거쳐 성안됐으며, 국회를 통과할 경우 공포 후 6개월이 경과한 날부터 시행될 예정이다.

People Power Party lawmaker Kim Mi-ae (Busan Haeundae-eul, two-term) on the 5th introduced an amendment to the Immigration Control Act requiring foreign crime statistics to be systematically compiled and disclosed by nationality and visa status.

The proposed amendment aims to establish a clearer legal framework for compiling and evaluating immigration and foreigner-related policies based on objective data. While the Ministry of Justice currently publishes statistics on immigration flows and the status of foreign residents, there has been no explicit legal basis for organizing and managing foreign crime statistics by nationality and visa category, limiting in-depth crime analysis and effective policy design.

Under the bill, the Minister of Justice would be required to compile and disclose, at least once a year, comprehensive data including immigration trends, the status of foreign residents by nationality and visa type, and statistics on crimes involving foreign nationals. To enhance accuracy and reliability, the bill also provides a legal basis for requesting relevant data from the heads of related agencies. Detailed matters regarding the compilation, management, and disclosure of statistics would be prescribed by Presidential Decree.

Rep. Kim emphasized that immigration and foreigner policies should be grounded in accurate statistics and objective data rather than emotions or political rhetoric. “This amendment is not intended to exaggerate foreign crime or stigmatize specific groups,” she said. “It is a minimum institutional reform aimed at accurately understanding the situation based on policy-relevant variables such as nationality and visa status, and at developing effective policies.”

She added that discussing policy without systematic statistics risks heightening public anxiety and repeating policy failures, stressing that the amendment would help establish a transparent and rational foundation for immigration and foreigner policy administration.

The bill was drafted following an official review by the National Assembly Legislative Counsel. If passed by the National Assembly, it will take effect six months after promulgation.
