브레이크뉴스 노보림 기자= 이른바 ‘부산 돌려차기 사건’으로 징역 20년을 확정받아 복역 중인 가해자가 수감 중 피해자를 보복 협박한 혐의 등으로 또다시 재판에 넘겨져 검찰로부터 징역 3년을 구형받았다.

 

부산지법 서부지원 형사1부(부장판사 김주관)는 12일 특정범죄가중처벌등에관한법률(보복협박 등) 위반과 모욕, 강요 혐의로 기소된 이모(30대)씨에 대한 결심공판을 열었다.

 

검찰 공소사실에 따르면 이씨는 2023년 2월 수감 생활을 하던 중 동료 재소자이자 유튜버인 A씨 등에게 ‘부산 돌려차기 사건’ 피해자 김 진주(필명)씨를 폭행하고 살해하겠다는 취지의 보복성 발언을 한 혐의를 받고 있다. 

 

이 같은 사실은 A씨가 출소 후 유튜브 방송에 출연해 밝히면서 알려졌는데 "이씨가 뉴스에 '돌려차기 사건'이 나올 때마다 억울해하면서 출소하면 피해자를 죽이고 성폭행할 것이라고 말하는 것을 들었다"는 취지의 말을 했다. 

 

이씨는 또한 면회를 안 온다며 자신의 전 여자 친구에게 협박성 편지를 보낸 혐의와 같은 방에 수감된 재소자에게 접견 구매 물품을 반입하도록 강요한 혐의도 함께 받고 있다.

 

앞서 이씨 측은 법정에서 보복 협박 혐의를 전면 부인했다. 또한 재판 과정에서 기일을 수차례 변경하거나 법정에 불출석하는 등 공판 절차를 지연시키기도 했다.

 

피해자 김씨는 이날 증인으로 직접 출석해 이씨의 보복 협박 사실을 알게 된 이후 극심한 불안과 신변 위협의 공포에 시달렸다고 호소하기도 했다.

 

이에 검찰은 “중대 강력 범죄의 피해자를 상대로 한 보복 협박은 사회적 비난 가능성이 크다”며 이씨에게 징역 3년을 선고해 달라고 재판부에 요청했다.

 

그러나 이씨 측 변호인은 “구치소 내에서 문제 발언을 했다며 신고한 사람은 없었고, 이씨가 해당 사안으로 징벌을 받은 사실도 없다”면서 “범행의 특별한 동기나 이유가 없고, 범죄가 충분히 증명됐다고 보기 어려운 만큼 무죄를 선고해 달라”고 주장했다.

 

이씨 역시 최후 진술에서 “피해자에게 이 자리를 빌려 사죄의 말씀을 드린다”며 “어떠한 보복을 하거나 실행할 이유나 마음은 전혀 없다”고 했다. 

 

재판부는 이씨에 대한 선고기일을 다음 달 12일로 지정했다. 이번 사건은 2023년 12월 28일 기소된 이후 약 2년여 만에 결론이 나오게 된다.

 

한편 이씨는 2022년 5월 22일 오전 5시께 부산진구의 한 길거리에서 일면식도 없는 김씨를 성폭행할 목적으로 뒤쫓아가 폭행한 ‘부산 돌려차기 사건’으로 대법원에서 징역 20년을 확정받아 현재 복역 중이다.

Mr. Lee's attorney previously denied the charges of retaliatory threats in court. He also delayed the trial by repeatedly rescheduling the hearing and failing to appear in court.

 

Mr. Kim, the victim, testified in person that day, stating that after learning of Mr. Lee's retaliatory threats, he suffered from extreme anxiety and fear of personal harm.

 

The prosecution requested a three-year prison sentence for Mr. Lee, stating, "Retaliatory threats against victims of serious violent crimes are highly likely to attract social condemnation."

 

However, Lee's lawyer argued, "No one reported him for making problematic remarks in the detention center, and Lee has never been punished for the incident." He added, "There is no specific motive or reason for the crime, and it is difficult to say that the crime has been sufficiently proven. Therefore, we ask for a not guilty verdict."

 

Lee also stated in his final statement, "I would like to take this opportunity to apologize to the victim," adding, "I have absolutely no reason or intention to seek or commit any retaliation."

 

The court set Lee's sentencing date for the 12th of next month. This case will reach a conclusion approximately two years after his indictment on December 28, 2023.

 

Meanwhile, Lee is currently serving a 20-year prison sentence confirmed by the Supreme Court for the "Busan Roundhouse Kick Incident," in which he chased and assaulted a stranger, Kim, with the intent to sexually assault her, on a street in Busanjin-gu around 5:00 AM on May 22, 2022.
