박성훈 의원, 적자 기업도 국가전략기술 투자 세액공제 환급 '조특법 개정안' 발의

국민의힘 박성훈 의원(부산 북구을)은 대규모 시설투자로 일시적 결손을 겪는 국가전략기술 기업이 세액공제 미공제액을 현금으로 환급받거나 제3자에게 양도할 수 있도록 하는 조세특례제한법 개정안을 30일 대표발의했다.
배터리를 비롯한 국가전략기술 산업은 미래 자동차, 인공지능(AI), 로봇, 에너지저장장치(ESS), 반도체, 방위산업 등 첨단산업 전반을 뒷받침하는 핵심 기반이다. 최근 글로벌 시장에서는 산업 경쟁력을 넘어 국가 경제안보를 좌우하는 전략산업으로 평가받고 있으며, 미국·유럽연합(EU)·중국 등 주요국은 대규모 보조금과 세제 혜택을 통해 자국 공급망 확보에 박차를 가하고 있다.
반면 한국의 현행 세액공제 제도는 법인세 납부세액에서 차감하는 방식으로 운영되어, 초기 대규모 시설투자와 연구개발(R&D)로 수년간 적자를 기록하는 기업들은 지원을 받지 못하는 구조적 사각지대에 놓여있었다.
이번 개정안은 이러한 한계를 해소하기 위해 직전 3개 사업연도 이상 연속하여 결손이 발생한 국가전략기술 영위 기업을 대상으로 한다. 법안이 통과되면 연구·인력개발비 세액공제와 사업화시설 투자세액공제의 미공제 금액을 현금으로 환급받거나 해당 권리를 제3자에게 양도할 수 있게 된다.
개정안은 세제지원의 실효성을 높이기 위해 환급받은 금액을 반드시 국내 시설투자나 연구·인력개발에 재투자하도록 규정했다. 이를 통해 단순한 재정지원을 넘어 국내 생산기반 확충과 기술 경쟁력 강화로 이어지도록 설계했다.
박성훈 의원은 배터리 산업이 국가 경제안보를 떠받치는 핵심 전략산업임에도 현행 세제는 흑자 기업에만 혜택이 집중되어 대규모 투자를 이어가는 기업에 실질적 도움이 되지 못했다고 지적했다.
박 의원은 지원이 필요한 기업이 적자라는 이유만으로 세제혜택을 받지 못하는 것은 공제율의 문제가 아니라 지원 방식의 문제라며, 이번 개정안을 통해 지원금이 국내 R&D와 시설투자로 다시 이어지는 선순환 구조를 만들어 산업 경쟁력 강화와 양질의 일자리 창출에 기여하겠다고 강조했다.

SEOUL, South Korea — Representative Park Sung-hoon of the People Power Party (Busan Buk-gu Eul district) introduced an amendment to the Restriction of Special Taxation Act on Thursday, proposing cash refunds or third-party transfers of unused tax credits for national strategic technology companies operating at a deficit.
National strategic technologies—including batteries, artificial intelligence (AI), semiconductors, robotics, energy storage systems (ESS), future mobility, and defense industries—serve as critical foundations for high-tech sectors and national economic security.
While major global competitors such as the United States, the European Union, and China offer massive subsidies and flexible tax incentives to secure domestic supply chains, South Korea's current tax credit framework applies only against corporate tax liabilities, leaving unprofitable firms unable to access real financial support during early investment phases.
To address this structural blind spot, the proposed amendment targets companies operating in national strategic technology sectors that have recorded losses for three or more consecutive fiscal years. Under the bill, these firms can receive cash refunds for unused tax credits related to research and development (R&D), workforce development, and commercialization facility investments, or transfer those refund rights to a third party.
The bill mandates that all refunded capital be reinvested into domestic facility expansion, R&D, or workforce development. This requirement ensures that financial relief directly leads to strengthening domestic manufacturing bases and technological competitiveness rather than serving as a simple monetary subsidy.
Representative Park emphasized that the current framework fails to support the very companies driving critical future investments due to a flawed delivery mechanism.
Failing to receive tax support simply because a company is in deficit is not a matter of the tax credit rate, but an issue with the delivery system itself, Park said. He added that the amendment aims to build a virtuous cycle where tax relief directly drives domestic R&D and facility reinvestments, ultimately securing global supply chain stability and creating quality jobs.
