[브레이크뉴스=배종태 기자] 국민의힘 박성훈 의원(부산 북구을)이 생성형 인공지능(AI) 서비스와 클라우드 등 디지털 환경에서 이뤄지는 전자정보 압수·수색 과정에서 국민의 기본권을 보다 두텁게 보호하기 위한 형사소송법 개정안을 대표발의했다.

 

박 의원은 6일 최근 생성형 AI 서비스의 확산으로 이용자가 AI와 주고받은 대화에 개인의 사고 과정과 고민, 정치적 견해, 종교적 신념, 건강정보 등 민감한 개인정보가 폭넓게 저장되고 있는 만큼, 디지털 시대에 맞는 전자정보 압수·수색 절차를 법률에 명확히 규정할 필요가 있다고 밝혔다.

 

최근 생성형 AI 대화기록은 단순한 정보 검색을 넘어 개인의 내밀한 사고와 가치관을 담고 있는 새로운 형태의 디지털 정보로 평가되면서 범죄 수사 과정에서 주요 증거로 활용되는 사례가 증가하고 있다. 그러나 현행법은 전자정보 압수·수색의 범위와 절차를 구체적으로 규정하지 않아 혐의와 무관한 대량의 개인정보까지 함께 확보되는 이른바 '포괄적 압수' 우려가 지속적으로 제기돼 왔다.

 

대법원도 그동안 판례를 통해 정보저장매체 등에 대한 압수·수색은 검색어 등을 활용한 선별적 압수를 원칙으로 해야 하며, 탐색과 복제, 출력 등 집행 전 과정에서 당사자의 참여권을 보장해야 한다고 판단해 왔다. 또한 피압수자와 피의자가 다른 경우에도 피의자가 해당 전자정보를 실질적으로 지배·관리하고 있다면 피의자의 참여권 역시 보장해야 한다는 입장을 유지하고 있다.

 

이번 개정안은 이러한 대법원 판례를 법률에 명문화하는 데 초점을 맞췄다.

 

개정안은 정보저장매체 등에 대한 압수·수색 영장에 검색어와 검색 대상 기간, 대상 계정, 파일 유형 등 압수 대상 전자정보의 범위를 특정하기 위한 집행계획을 명시하도록 했다. 또 영장 청구 단계에서도 동일한 내용을 기재하도록 해 법원의 심사를 강화하고, 피고인·피의자와 피압수자가 서로 다른 경우에도 양측 모두에게 압수·수색 절차 참여권을 보장하도록 규정했다.

 

박 의원은 이번 개정안을 통해 수사기관이 범죄 혐의와 관련된 정보만 선별적으로 확보하도록 함으로써 압수·수색의 적법성과 투명성을 높이고, 생성형 AI 대화기록 등 새로운 디지털 정보에 대한 과도한 수집을 방지해 국민의 사생활과 개인정보 보호를 강화할 수 있을 것으로 기대했다.

 

박성훈 의원은 "생성형 AI와 나눈 대화에는 단순한 기록이 아니라 개인의 생각과 고민, 가치관 등 가장 내밀한 정보가 담겨 있다"며 "디지털 기술의 발전에 맞춰 수사기법도 발전해야 하지만, 그 과정에서 헌법이 보장하는 영장주의와 적법절차 원칙은 더욱 엄격하게 지켜져야 한다"고 말했다.

 

이어 "이번 개정안은 수사를 위축시키기 위한 것이 아니라 필요한 증거는 적법하게 확보하면서도 혐의와 무관한 개인정보까지 무분별하게 수집되는 일을 방지하기 위한 제도적 장치"라며 "전자정보 압수·수색 절차의 예측 가능성과 국민의 기본권 보호를 함께 강화하는 계기가 되기를 기대한다"고 밝혔다.

People Power Party lawmaker Park Sung-hoon, who represents Busan's Buk-gu Eul constituency, has introduced a revision to the Criminal Procedure Act aimed at strengthening the protection of citizens' fundamental rights during the search and seizure of electronic information in digital environments, including generative artificial intelligence (AI) services and cloud platforms.

 

Park announced the bill on Wednesday, saying the rapid expansion of generative AI services has resulted in users storing highly sensitive personal information through conversations with AI, including thought processes, personal concerns, political views, religious beliefs, and health-related information. He argued that clear legal standards are needed to ensure search and seizure procedures keep pace with the digital era while safeguarding constitutional rights.

 

As AI conversations increasingly contain deeply personal information beyond simple search queries, such records are becoming a new form of digital evidence frequently used in criminal investigations. However, current law does not provide sufficiently detailed rules governing the scope and procedures for electronic data searches and seizures, raising concerns that investigators may collect large volumes of personal information unrelated to alleged crimes through overly broad searches.

 

The Supreme Court has consistently ruled that searches of digital storage devices should be conducted selectively, using search terms and other methods to limit the scope of data collection. The Court has also held that individuals subject to searches must be guaranteed the right to participate throughout the execution process, including data searches, copying, and extraction. Furthermore, even when the owner of the seized device differs from the criminal suspect, the suspect's participation rights should be protected if the suspect exercises substantial control over the electronic information.

 

The proposed amendment would codify these judicial principles into law. Under the bill, search warrants for electronic information would be required to specify an execution plan detailing the scope of the search, including search keywords, the relevant time period, targeted accounts, and file types. Prosecutors would also be required to include the same information when applying for warrants, enabling courts to conduct more rigorous judicial review. In addition, the legislation explicitly guarantees participation rights for both the suspect or defendant and the individual whose electronic information or storage device is being searched when they are different persons.

 

According to Park, the amendment is designed to ensure that investigative authorities collect only information directly related to suspected criminal offenses, thereby enhancing the legality and transparency of digital search and seizure procedures while preventing excessive collection of AI conversation records and other sensitive digital information. He said the legislation would provide stronger protection for citizens' privacy and personal data in an increasingly digital society.

 

"Conversations with generative AI contain far more than simple records—they reflect a person's thoughts, concerns, values, and other deeply private information," Park said. "As digital technology advances, investigative techniques must also evolve. At the same time, however, the constitutional principles of judicial warrants and due process must be observed even more strictly."

 

He added, "This bill is not intended to hinder criminal investigations. Rather, it establishes safeguards that allow investigators to lawfully obtain necessary evidence while preventing the indiscriminate collection of personal information unrelated to alleged crimes. I hope it will improve both the predictability of electronic search and seizure procedures and the protection of citizens' fundamental rights."
