이화영 전 경기도 평화부지사의 ‘쌍방울 대북송금’ 의혹 수사를 담당했던 박상용 검사가 법무부 감찰위원회(이하 감찰위) 출석 후 감찰 절차의 공정성에 강한 의문을 제기하며, 논란의 핵심인 녹취 파일의 전면 공개를 요구했다.

 

박 검사는 지난 14일 자신의 페이스북을 통해 전날 진행된 법무부 감찰위 출석 사실을 밝히며 자신에게 충분한 소명 기회와 자료가 제공되지 않은 점과 함께 감찰 절차의 공정성에 문제를 제기했다.

 

"자료도 없이 지금 듣고 소명하라" 감찰 절차 정당성 문제 제기

 

박 검사에 따르면, 당초 그는 법무부 감찰관실 측에 충분한 소명을 위해 감찰 기일의 일주일 연기를 요청하고, 의혹 제기의 근거로 제시된 서민석 변호사와의 녹취 자료를 사전에 제공해달라고 요구했다. 그러나 감찰위는 '지금 이 자리에서 녹취를 듣고 소명하라'는 입장을 고수하며 이를 불허했다.

 

박 검사는 이와 관련해 "작년 9월 감찰 지시 후 1년 가까이 검찰 및 특검 수사가 진행됐고, 직무 정지만 4개월이 넘었으며, 법무부의 조사도 3개월간 이어졌다"며 "정작 징계 대상자에 대한 사전 조사도 없이 자료조차 공개하지 않다가 갑작스럽게 당일 현장에서 소명을 강요하는 것은 절차적 정당성을 상실한 처사"라고 강하게 비판했다.

 

"녹취 직접 들어보니 대화 맥락 명확… 어떠한 문제도 발견할 수 없어"

 

현장에서 2023년 5월 25일 자와 6월 19일 자로 구성된 총 30분 분량의 녹취 파일을 청취한 박 검사는 "직접 들어보니, 대화의 맥락이 명확해졌으며 어떠한 문제도 발견할 수 없었다"며 "왜 지금까지 조사 기관들이 녹취 파일 전체를 공개하지 않고 숨겨왔는지 그 이유를 비로소 알게 되었다"고 지적했다. 이어 해당 파일조차 온전한 통화 기록이 아니었음을 지적하며 자료의 불완전성도 함께 주장했다.

 

"진실은 징계할 수 없다"… 녹취 파일 전면 공개 요구

 

박 검사는 이번 사건이 "‘연어술파티’ 이후 새롭게 등장한 의혹으로 요란하게 나라 전체를 뒤흔들었던 건"이라며, "국민의 알권리를 위해 반드시 전체 녹취파일이 공개되어야 한다"고 강하게 촉구했다.

 

그는 여당, 언론사, 특검, 공수처, 대검찰청, 법무부 등 관계 기관을 향해서도 "의혹 제기와 비난만 앞세우지 말고 서민석 변호사와의 녹취 파일 전체를 투명하게 공개하라"고 공개 요구했다.

 

마지막으로 박 검사는 "감찰위나 징계위가 어떤 결정을 내리더라도 그것은 지속될 수 없으며, 언젠가 반드시 파기될 것"이라며, "나를 징계할 수는 있어도 진실을 징계할 수는 없다"는 강경한 입장을 고수했다.

 

현재 박상용 검사가 주장한 감찰 절차의 공정성 논란과 녹취 파일 공개 요구가 이어짐에 따라, 향후 법무부 감찰위원회의 권고와 이에 따른 징계 절차가 어떠한 결론으로 이어질지 법조계와 정가를 비롯한 국민적 이목이 집중되고 있다.

On the 14th, Prosecutor Park revealed via his Facebook page that he had attended the Committee hearing the previous day, raising concerns about the fairness of the inspection procedure and pointing out that he was not provided with sufficient opportunity to explain himself or any materials.

 

"Listen and explain now without materials": Questioning the legitimacy of the inspection procedure

 

According to Prosecutor Park, he initially requested a one-week postponement of the inspection date to allow for sufficient explanation, and demanded that the audio recording with Attorney Seo Min-seok—presented as the basis for the allegations—be provided in advance. However, the Committee refused, maintaining its stance that he must "listen to the recording and explain right here and now."

 

Regarding this matter, Prosecutor Park strongly criticized the situation, stating, "Investigations by the prosecution and the special prosecutor have been ongoing for nearly a year since the internal inspection order was issued last September, and the suspension of duties alone has lasted over four months, while the Ministry of Justice's investigation has continued for three months." He added, "Forcing an explanation on the spot on the day of the incident, after failing to disclose materials and conducting no preliminary investigation into the person subject to disciplinary action, is an act that has lost its procedural legitimacy."

 

"Listening to the recordings directly, the context of the conversation is clear... No issues found"

 

Prosecutor Park, who listened to a total of 30 minutes of audio files at the scene covering May 25 and June 19, 2023, pointed out, "Listening to them directly, the context of the conversation became clear, and I could not find any issues." He noted, "I finally understood why the investigative agencies had been hiding the entire audio file instead of disclosing it until now." He further argued for the incompleteness of the data, pointing out that even the file in question was not a complete call record.

 

"The truth cannot be disciplined"... Demand for Full Disclosure of Audio Recordings

 

Prosecutor Park strongly urged that "the entire audio recording must be disclosed for the sake of the public's right to know," stating that this case "shook the entire nation with noise due to suspicions that emerged anew following the 'Salmon Drinking Party'."

 

He also demanded that relevant agencies, including the ruling party, media outlets, the Special Counsel, the Corruption Investigation Office for High-ranking Officials (CIO), the Supreme Prosecutors' Office, and the Ministry of Justice, "transparently disclose the entire audio recording with Attorney Seo Min-seok, rather than merely prioritizing the raising of suspicions and criticism."

 

Finally, Prosecutor Park maintained a firm stance, stating, "No matter what decision the Inspection Committee or the Disciplinary Committee makes, it cannot be sustained and will inevitably be overturned someday," adding, "They may discipline me, but they cannot discipline the truth." As the controversy regarding the fairness of the inspection process and the demand for the release of audio recordings, as claimed by Prosecutor Park Sang-yong, continue, the public, including the legal and political circles, is focusing their attention on what conclusions the recommendations of the Ministry of Justice Inspection Committee and the subsequent disciplinary proceedings will reach.
