[Here is the English version of the article] Illegal Short-Selling Detections Surge 38-Fold in 5 Years... Calls Grow for Faster Investigations and Sanctions
While the introduction of the Name-Based Short-Selling Detection System (NSDS) has significantly boosted capabilities to catch illegal short selling, calls are growing for urgent follow-up measures—including swift investigations, strict sanctions, and the recovery of illicit profits—beyond mere detection.
According to data submitted by the Financial Supervisory Service (FSS) to Rep. Park Sung-hoon of the People Power Party, suspected illegal short-selling cases reported to the regulator surged 38-fold from 2 in 2020 to 77 in 2025. The numbers steadily rose over the period: 17 in 2021, 22 in 2022, 39 in 2023, and 47 in 2024. Through July this year, 42 cases have been reported, bringing the total cumulative cases since 2020 to 246.
This sharp rise in detections is largely attributed to the operation of the NSDS, which was launched on March 31 last year alongside the full resumption of short selling. The NSDS continuously monitors short-selling entities by calculating hourly balances and inspecting sell orders to flag illegal practices such as naked short selling.
During the 16 months since its launch, the NSDS detected a total of 94 suspected cases. Notably, 36 out of the 42 cases (85.7%) reported through July this year were caught by the system. While the Korea Exchange previously inspected only selected accounts or institutions from daily trading data, the NSDS allows continuous monitoring of 25 major institutional investors, significantly enhancing detection capabilities.
However, critics emphasize that increasing detection numbers alone will not resolve market distrust or the lingering controversy over an "unlevel playing field." Substantial deterrence can only be achieved when detected cases lead to prompt investigations, stern sanctions, and the full disgorgement of illegal gains.
"Policy promotion claiming that the detection system is working is not enough to eliminate market distrust," Rep. Park stated. "As the number of monthly detected cases continues to rise, the entire follow-up process—from investigation and sanctions to profit recovery—must move swiftly."
