[브레이크뉴스=배종태 기자] 박상용 검사는 11일 자신의 페이스북을 통해 현재 정치권을 중심으로 논의되는 ‘조작기소 특검’과 이를 통한 ‘공소취소’ 가능성에 대해 강한 우려를 표했다. 박 검사는 이러한 일련의 과정을 ‘보이스피싱’에 비유하며 국민들의 주의를 당부했다.

9월 공소취소와 10월 검찰 폐지 시나리오 전망

박 검사는 소셜미디어를 통해 현재 진행 중인 국정조사와 향후 발족될 특검의 목적이 사법 시스템의 무력화에 있다고 주장했다. 

그는 “불법 국정조사가 끝나고 조작기소 특검이 발족되면, 통상의 특검 기간이 오는 9월경 특검에 의한 공소취소가 논의될 것”이라며, “9월 공소취소, 10월 검찰 폐지로 이어지는 권력자의 시나리오대로 국민들의 법치가 무너지고 있다”고 진단했다.

법치 파괴를 보이스피싱 범죄에 비유

박 검사는 현 상황을 보이스피싱 범죄에 비유하며 이성적인 판단을 요청했다. 그는 “보이스피싱은 당하고 나면 피해를 되돌리기 어렵듯, 법치가 무너진 다음에는 원래대로 되돌리기 어렵다”며 “혹시 받고 있을지 모르는 보이스피싱 전화를 잠시 끊고 이성과 양심의 눈으로 사안을 살펴달라”고 당부했다.

특히 재심이나 검찰에 의한 공소취소 등 기존 법적 절차가 있음에도 불구하고, 전례 없는 ‘특검에 의한 공소취소’가 고집되는 상황을 “괴물 같은 제도”라고 비판했다.

모든 수사와 재판은 수용... 다만 제도 망가뜨려선 안 돼”

박 검사는 자신을 향한 수사와 기소 절차에는 당당히 임하겠다는 입장을 밝혔다. 그는 “잘못한 게 있다면 국민이 가진 법치와 제도로 처벌해달라”며 “경찰, 검찰, 공수처, 특검 수사 그 어떤 것도 달게 받고 기소되면 재판에 성실히 임하겠다”고 강조했다.

다만 박 검사는 “사법부에서 자신의 사건을 빼앗아 권력으로 자신의 죄를 없애는 특검에 의한 공소취소가 허용되어서는 안 된다”며 “70여 년 가꾸어 온 법치와 제도를 망가뜨리고 권력이 제 욕심을 채우는 보이스피싱은 당해서는 안 된다”고 경고했다.

Park criticizes the 'Special Prosecutor’s Dismissal of Indictment' scenario on Facebook

“A monstrous system designed to seize court cases and erase guilt... Rule of Law will collapse”

Prosecutor Park Sang-yong on the 11th expressed strong concern through his Facebook post over the ongoing political discussions about a so-called “Fabricated Indictment Special Counsel” and the possibility of indictment cancellations that could follow. He likened the entire process to “voice phishing,” urging the public to stay alert.  

Scenario of Indictment Cancellation in September and Prosecution Abolition in October  

Through his social media post, Park argued that the ongoing parliamentary investigation and the soon-to-be-launched special counsel are aimed at undermining the judicial system.  

He said, “Once the illegal parliamentary inquiry concludes and the fabricated indictment special counsel is launched, discussions on indictment cancellations led by the special counsel will likely take place around September, the typical period for such investigations.” He warned that “under the scenario envisioned by those in power, the rule of law is collapsing—with indictment cancellations in September leading to the abolition of the prosecution by October.”  

Voice Phishing as a Metaphor for the Destruction of Law  

Park compared the current situation to voice phishing crimes, calling for level-headed judgment from the public. “Just as it is almost impossible to recover after a voice phishing scam, it is equally difficult to restore the rule of law once it collapses,” he wrote. He urged, “If you might be receiving a kind of voice phishing call, pause for a moment and look at this issue with the clear eyes of reason and conscience.”  

He was especially critical of the insistence on “indictment cancellation by a special counsel,” calling it a “monstrous system,” while existing legal mechanisms such as retrials or prosecutorial dismissals already exist.  

“I Will Accept Any Investigation, But the System Must Not Be Destroyed”  

Park stated that he is willing to undergo any investigation or legal procedure directed at him. “If I have done something wrong, punish me through the rule of law that the people uphold,” he said. “I will face any investigation by the police, prosecution, the Corruption Investigation Office, or a special counsel, and if indicted, I will sincerely stand trial.”  

However, he stressed that “a special counsel canceling indictments to erase one’s own wrongdoing through power should never be allowed.” He warned, “For more than seventy years, we have built a system of law and justice. It must not be destroyed or used as a tool for personal ambition. We must never fall for this kind of voice phishing.”
