[브레이크뉴스=배종태 기자] 부산시는 부산해사국제상사법원 설치 법안이 12일 국회 본회의를 통과함에 따라, 법원이 2028년 3월 1일 공식 개원한다고 밝혔다. 이는 시와 시민이 2017년부터 추진해 온 해사법원 유치 노력의 결실이다.

영호남·제주권 관할 전문 법원

새로 설치되는 부산해사국제상사법원은 영남·호남·제주권의 해사민사사건, 해사행정사건, 국제상사사건을 전문적으로 담당한다.  

관할 지역은 부산, 울산, 대구, 경남, 경북, 광주, 전남, 전북특별자치도, 제주특별자치도 등으로 구성된다. 법원은 개원 준비 절차를 거쳐 독립된 사법체계를 갖춘 후 정식 업무를 시작할 예정이다.

시민과 함께한 10년 노력의 결실

부산시는 2017년 시민단체와 함께 ‘해사법원 부산설립 범시민 추진협의회’를 꾸려 국내 최초로 해사법원 설립 필요성을 공식 제기했다.  

같은 해 연구용역을 통해 부산 유치 논리를 체계화했고, 2022년 이후 법조계와 학계, 해운항만업계와 협력해 정책토론회, 세미나, 모의재판 등을 열며 사회적 공감대를 확산했다.

해사중재 기반 강화

시는 해사 법률·중재 기반 확대를 위해 2018년 대한상사중재원과 함께 국내 유일의 ‘아태해사중재센터’를 개소했다. 또한 국회와 법원행정처를 꾸준히 설득하며 부산해사법원 설치의 필요성과 당위성을 지속적으로 제시해 왔다.

“대한민국 해양수도 위상 강화 계기”

박형준 부산시장은 “부산해사국제상사법원 설치는 해양수산부와 해운선사 본사 이전, 해양 공공기관과의 융합을 통해 지역경제를 활성화하고 부산의 해양수도 위상을 강화할 것”이라고 말했다. 

그는 “시민들의 지지와 협력에 감사드리며, 법원이 차질 없이 개원하도록 유관기관과 협력체계를 구축하고 행정 지원을 아끼지 않겠다”고 밝혔다.

The Busan Metropolitan Government announced Thursday that the bill to establish the Busan Maritime and International Commercial Court passed the National Assembly, officially confirming its opening on March 1, 2028. The decision marks the culmination of nearly a decade of efforts by the city and its citizens to bring a maritime court to Busan.

Specialized jurisdiction over maritime and commercial cases  

The new court will handle maritime civil and administrative cases as well as international commercial disputes across the southeastern and southwestern regions, including Jeju.  

Its jurisdiction will cover Busan, Ulsan, Daegu, Gyeongsangnam-do, Gyeongsangbuk-do, Gwangju, Jeollanam-do, Jeonbuk Special Self-Governing Province, and Jeju Special Self-Governing Province. The court will establish an independent judicial system before commencing operations in 2028.

Years of public and institutional support  

Busan launched the Citizen Promotion Council for the Establishment of the Maritime Court in 2017 to officially advocate for the nation’s first maritime court.  

Since then, the city conducted multiple policy studies, public forums, mock trials, and symposiums with legal, academic, and maritime industry partners to promote the feasibility and necessity of locating the court in Busan.

Strengthening maritime arbitration  

In 2018, the city and the Korean Commercial Arbitration Board jointly opened the Asia-Pacific Maritime Arbitration Center, the nation’s only maritime arbitration body, to strengthen the dispute resolution infrastructure. Busan also continued to lobby the National Assembly and the Judicial Administration to highlight the need for a specialized maritime court.

Busan Mayor Park Heong-joon welcomed the bill’s passage, saying it would reinforce Busan’s position as South Korea’s maritime capital.  

“The establishment of the Busan Maritime and International Commercial Court will invigorate the regional economy and strengthen Busan’s role as Korea’s leading maritime city,” Park said. “We will ensure the court opens as planned, working closely with related institutions and providing full administrative support.”
