[브레이크뉴스=배종태 기자] 부산시는 오는 23일부터 4월 30일까지 의약분업 예외지역 내 약국과 의료기관, 그리고 시내 의약품 도매상을 대상으로 불법 의약품 조제·판매 행위를 집중 단속한다고 19일 밝혔다.  

의약분업 예외지역은 의료기관과 약국을 함께 이용하기 어려운 지역 주민의 편의를 위해 지정된 곳으로, 약사가 처방전 없이 의약품을 조제할 수 있다. 하지만 일부 지역에서는 이 제도를 악용해 무자격자가 조제나 판매를 하는 등 불법 행위가 지속적으로 발생해왔다.  

이번 단속은 ▲무자격자의 조제·판매 ▲약사 면허 대여 및 알선 ▲도매업무관리자 미지정 ▲불법·위해 의약품 유통 ▲의약품 안전관리 위반 등을 중점적으로 점검한다. 시는 위법 행위가 적발되면 형사 입건과 함께 행정기관의 엄정한 조치를 취할 방침이다.  

현행 「약사법」에 따르면 약사 면허를 대여하거나 알선할 경우, 또는 무자격자가 의약품을 판매할 경우 5년 이하의 징역이나 5천만 원 이하의 벌금에 처해질 수 있다. 또 도매업무관리자를 지정하지 않거나 품질관리를 소홀히 할 경우 최대 3년 이하의 징역 또는 3천만 원 이하의 벌금, 의약품 유통품질관리기준을 위반할 경우 1년 이하의 징역 또는 1천만 원 이하의 벌금이 부과된다.  

시 특별사법경찰과는 약사법 위반 신고를 접수하고 있으며, 시민은 공중위생수사팀(051-888-3104~3106)으로 제보할 수 있다.  

박형준 부산시장은 “이번 단속을 통해 의약분업 예외지역 제도의 투명성을 높이고 불법 유통 구조를 차단하겠다”며 “제도의 취지가 훼손되지 않도록 시민이 안심하고 의약품을 구입할 수 있는 건강한 유통환경을 만들겠다”고 말했다.

The Busan Metropolitan Government will conduct an intensive crackdown on illegal drug dispensing and sales from Feb. 23 to April 30, targeting pharmacies and medical institutions in prescription exemption zones, as well as pharmaceutical wholesalers across the city. 

Prescription exemption zones are designated to improve access to medicine for residents in areas where it is difficult to use both medical institutions and pharmacies, allowing pharmacists to dispense drugs without a doctor’s prescription. However, authorities say some operators have abused these exceptions, with unlicensed individuals dispensing and selling medicines, posing a threat to public health.

The crackdown will focus on illegal prescribing, dispensing and sales in exemption zones, the lending and borrowing of pharmacist licenses, dispensing or sales by unqualified persons, failure to appoint wholesale business managers, distribution of illegal or harmful medicines and violations of drug safety management rules.

If violations are detected, the city plans to pursue criminal charges and request strict administrative measures from the relevant authorities. Under the Pharmaceutical Affairs Act, those who lend or borrow a pharmacist’s license, arrange such transactions or sell medicines without proper qualifications face up to five years in prison or fines of up to 50 million won.

In addition, failure to designate a wholesale manager, neglect of quality control duties or selling medicines outside licensed pharmacies can result in up to three years in prison or fines of up to 30 million won, while violations of drug distribution quality control standards are punishable by up to one year in prison or fines of up to 10 million won. 

The city’s special judicial police unit is accepting citizen reports of suspected Pharmaceutical Affairs Act violations through its public health investigation team. 

Mayor Park Heong-joon said the crackdown is expected to enhance transparency in the exemption zone system and block illegal distribution and management practices by drug wholesalers, stressing that a system created for residents in medically underserved areas must not lose credibility due to the illegal acts of a few operators.
